OBSERVATIONS ON COMMUNICATIONS RECEIVED

 

In the period covered by this report, the Commission examined 289 communications or claims from persons and organizations denouncing 100 concrete cases of alleged violations of the human rights embodied in the American Declaration of the Rights and Duties of Man. In addition it also received communications reporting on the general status of these rights in the American countries.

 

As to processing given each case (Articles 37 to 51 of the Regulations), the Commission proceeded to examine the evidence adduced by the government concerned or by the person making the denunciation or such evidence as the Commission itself was able to gather, in accordance with Article 50 of the Regulations, applying where appropriate the rule on presumption of confirmation set forth in Article 51.

 

In accordance with its Statute (Article 9 (bis) c), the Commission feels that its annual report to the General Assembly should comment only on those cases in which processing and examination were completed during the period covered by the report and in which a violation of human rights was confirmed and regarding which, pursuant to Articles 52 and 56 of its Regulations, appropriate recommendations were made to the government against which the denunciation was filed.

 

Therefore, in compliance with Resolution XII of the Second Special Inter-American Conference (paragraph 4), Article 150 of the Charter of the Organization of American States, and Article 57 of its Regulations, the Commission submits to the General Assembly for its consideration the observations it considers appropriate with respect to the cases that meet the above-mentioned conditions.
